License terms
What you are buying, in the same words the product uses. Short on purpose: every clause here answers a question somebody would otherwise have to ask after paying.
1. Who you are contracting with
SpamSpike is operated by the entity named above (“we”, “us”). Payment is processed by Stripe, which acts as merchant of record for the sale: Stripe charges you, issues your receipt and invoice, and is responsible for calculating and remitting any sales tax or VAT. The licence itself, and the service, are ours.
2. What the licence covers
A licence grants one named person, at the email address that paid, a non-exclusive right to use SpamSpike version 1.x for one Klaviyo account, together with every Google Postmaster Tools domain you choose to track alongside it. It does not expire. There is no subscription, no seat count and no per-domain fee.
All 1.x updates are included for as long as 1.x exists. Major versions (2.0 and later) are optional paid upgrades: they are never forced on you, your 1.x licence keeps working if you decline, and licence holders are entitled to any 2.0+ upgrade at half its then-current price.
A second Klaviyo account needs a second licence. If your Klaviyo account changes hands or you move to a different one for the same brand, write to us and we will move the licence — that is a change of account, not a new sale.
3. What you provide
SpamSpike analyses your data through your own connections. You need a Google account with access to Google Postmaster Tools for your sending domains, and a Klaviyo API key. Both are used read-only. You are responsible for having the right to grant that access, and you may revoke either at any time from Settings — the product keeps working on whatever it has already read.
4. What we do not do
SpamSpike does not send email, cannot send email, and has no ability to modify anything in your Klaviyo account. It does not read any inbox. It does not store individual recipient records: what it holds is aggregate reporting — rates, counts, campaign and flow metadata, and Google’s own aggregated domain statistics. 5. Findings are evidence, not advice
The product labels every conclusion with its confidence — Identified, Likely or Possible — and states the evidence behind it. Those labels mean what they say. SpamSpike tells you what correlated with a complaint window; it cannot prove causation, and it does not claim to. Deliverability outcomes depend on Gmail and other mailbox providers, whose decisions are theirs alone. Nothing here is a guarantee of inbox placement, a spam rate, or any commercial result.
6. Availability, and what “lifetime” honestly means
This is a hosted service, so a perpetual licence deserves a straight answer about what happens if we stop hosting it. We do not promise a specific uptime figure and we are not offering a service-level agreement at this price. What we do commit to:
- If we discontinue SpamSpike, we will give at least 90 days’ notice by email to every licence holder.
- During that period your data stays exportable, and revoking our access to Google and Klaviyo stays available.
- If we discontinue it within 12 months of your purchase, we will refund you in full — a lifetime that lasted a year was not the thing you bought.
Beyond that, treat “lifetime” as the lifetime of the product, not a guarantee of eternity. That is the honest reading and we would rather write it down than let you infer something else.
7. Payment and refunds
The price is the one shown at the moment you buy, and it is the price you pay — it never changes afterwards for a licence already sold. Prices may rise as licence tiers fill. Sales are final; the reasoning, and the statutory exceptions that apply to consumers in the EU, are set out in the refund policy, which forms part of these terms.
8. Acceptable use
Use SpamSpike for your own brands or for clients you are engaged by. Do not resell access, share one licence across unrelated businesses, attempt to extract the underlying analysis for a competing product, or use it to attack, probe or overload any system — ours, Google’s or Klaviyo’s. We may suspend a licence that is being used this way, and will say why.
9. Liability
To the fullest extent the law allows, our total liability to you for any claim arising from SpamSpike is limited to what you paid for your licence. We are not liable for lost revenue, lost sending reputation, or decisions taken on the basis of the product’s findings. Nothing here limits liability that cannot lawfully be limited, including for fraud, or for a consumer’s statutory rights.
10. Changes
We may update these terms. If a change materially reduces what your licence covers, it does not apply to licences already sold — you keep the terms you bought under. Other changes take effect when posted, with the date above updated.
11. Law
These terms are governed by the laws of the Republic of Lithuania, and the courts there have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.
